DON Terms of Use

Effective date: October 11, 2026

These Terms of Use (“Terms”) are a binding agreement between you and Paridym Agency Inc. (“Paridym,” “DON,” “we,” “us,” or “our”). They govern your access to and use of the DON application, websites, and related services (collectively, the “Service”).

By creating an account, accepting these Terms, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering a binding agreement. You may use the Service only in compliance with applicable law. You may not use the Service if you are prohibited from receiving it under applicable law or sanctions.

2. Your account

You must provide accurate account information and protect your credentials. You are responsible for activity performed through your account unless caused by our breach of duty. Notify support@paridym.ai promptly if you believe your account has been compromised.

You may not share credentials, impersonate another person, create an account for someone without authority, or attempt to bypass access, subscription, safety, or security controls.

3. The Service

DON provides AI-assisted conversation, planning, productivity, voice, workout, health and fitness context, reminders, integrations, and related personal operating-system features. Features may change, differ by device or subscription, require permissions or connected services, or be provided in beta.

DON may prepare recommendations or proposed actions. A proposal is not proof that an external action occurred. You are responsible for reviewing information and confirming consequential actions.

4. AI features

AI output may be probabilistic, inaccurate, incomplete, offensive, or unsuitable. You must independently evaluate output before relying on it. Similar inputs may generate different outputs, and different users may receive similar outputs.

DON may use OpenAI, xAI, and other disclosed processors to provide AI features after obtaining required permission. Your use of AI features is also subject to the AI Processing Notice and Privacy Policy.

You may not use the Service to develop, distribute, or facilitate malware; evade safeguards; exploit or harm others; generate unlawful content; violate intellectual-property, privacy, publicity, or other rights; conduct unauthorized surveillance; make high-impact decisions about another person without lawful authority and appropriate human review; or engage in fraud, deception, harassment, abuse, or illegal activity.

5. Health, safety, legal, and financial limitations

DON is a general wellness, planning, and informational service. It is not a medical device, healthcare provider, therapist, emergency service, law firm, accounting firm, broker, investment adviser, or fiduciary.

DON does not diagnose, treat, cure, or prevent disease and does not provide professional medical, mental-health, legal, tax, accounting, or investment advice. Consult a qualified professional for decisions requiring professional judgment.

If you believe you or another person may be in immediate danger or experiencing a medical or mental-health emergency, contact local emergency services. In the United States, call or text 988 for the Suicide & Crisis Lifeline when appropriate.

6. Apple Health and device permissions

HealthKit, microphone, Calendar, Reminders, notification, and other permissions are optional and controlled through Apple interfaces. You are responsible for reviewing permission requests and device settings. DON’s use of personal information is described in the Privacy Policy and Consumer Health Data Privacy Policy.

7. Connected services

If you connect a third-party service, you authorize DON to access or transmit the information necessary to provide the requested integration. Your use of the third-party service remains subject to that provider’s terms. We are not responsible for third-party service availability, acts, omissions, or changes.

Disconnecting a service stops future supported synchronization but may not delete information previously imported into DON. Use DON’s deletion controls or contact privacy@paridym.ai when you want previously imported information deleted.

8. Subscriptions and purchases

Paid features may require an auto-renewable subscription purchased through Apple. Prices, billing periods, trials, renewal, cancellation, refunds, and subscription management are described at the point of purchase and in the DON Subscription Terms.

Apple processes App Store payments. Deleting your DON account does not automatically cancel an Apple subscription.

9. Your content

You retain ownership of content you submit. You grant Paridym a limited, nonexclusive, worldwide license to host, copy, transmit, format, analyze, and otherwise process your content only as reasonably necessary to provide, secure, maintain, improve, and comply with law concerning the Service, consistent with the Privacy Policy and your permissions.

You represent that you have the rights and lawful authority needed to submit your content and direct its processing. Do not submit another person’s sensitive information without lawful authority and an appropriate basis.

10. Paridym materials

The Service, software, designs, branding, documentation, and other Paridym materials are owned by Paridym or its licensors and protected by law. Subject to these Terms, Paridym grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for its intended purposes.

You may not copy, sell, sublicense, reverse engineer, interfere with, scrape, probe, or create derivative works from the Service except to the limited extent such restriction is prohibited by law.

11. Feedback

If you submit feedback, you grant Paridym permission to use it without restriction or compensation, provided we do not publicly identify you without permission.

12. Suspension and termination

You may stop using DON and request account deletion at any time. We may suspend or terminate access when reasonably necessary to protect users or the Service, investigate misuse, comply with law, address nonpayment, or enforce these Terms. Where appropriate, we will provide notice and an opportunity to appeal.

Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute terms—remain effective.

13. Service changes

We may modify, suspend, or discontinue features. We do not guarantee that every feature, integration, model, or provider will remain available. If a material change affects a paid subscription, available remedies remain subject to applicable law and Apple’s purchase rules.

14. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Paridym disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and uninterrupted availability. We do not warrant that output will be correct, that the Service will meet every requirement, or that all errors will be corrected.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

15. Limitation of liability

To the fullest extent permitted by law, Paridym and its directors, officers, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill, or opportunities; or decisions made in reliance on AI output.

To the fullest extent permitted by law, Paridym’s aggregate liability arising from the Service or these Terms will not exceed the greater of (a) the amount you paid Paridym through the Service during the twelve months before the event giving rise to the claim or (b) one hundred United States dollars.

These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Paridym and its personnel from third-party claims, damages, and reasonable costs arising from your unlawful use of the Service, your violation of these Terms, or content you submit without sufficient rights. This section does not require indemnification for Paridym’s own unlawful conduct.

17. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles, except that applicable federal law governs federal questions. Subject to any mandatory consumer rights, you and Paridym consent to the jurisdiction of courts of competent jurisdiction located in Arizona.

Nothing in these Terms limits nonwaivable rights or remedies available under the law where you live.

Before filing a claim, you and Paridym agree to make a good-faith effort to resolve it informally for at least 30 days. Send a dispute notice to support@paridym.ai with your name, account email, a description of the dispute, and the requested resolution.

18. Apple-required terms

These Terms are between you and Paridym, not Apple. Paridym, not Apple, is solely responsible for DON and its content, maintenance, support, warranties, and claims, subject to applicable law.

Your license to use DON is limited to a nontransferable license to use it on Apple-branded products that you own or control as permitted by the Apple Media Services Terms and applicable Family Sharing or volume-purchase rules.

Apple has no obligation to furnish maintenance or support services. If DON fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as provided by its rules. To the maximum extent permitted by law, Apple has no other warranty obligation.

Paridym, not Apple, is responsible for addressing claims relating to DON, including product-liability claims, regulatory claims, consumer-protection claims, and intellectual-property claims. You represent that you are not located in a country subject to a United States government embargo and are not listed on a prohibited or restricted-party list.

You must comply with applicable third-party terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-related provisions against you.

19. Changes to these Terms

We may update these Terms. We will provide notice appropriate to the materiality of a change. If required by law, we will obtain your agreement before the updated Terms apply. Continued use after an effective update constitutes acceptance where permitted by law.

20. General

These Terms, the Privacy Policy, Subscription Terms, and notices incorporated by reference form the agreement concerning the Service. If any provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Paridym may assign them in connection with a reorganization, merger, acquisition, or sale of assets.

Paridym SMS Terms

SMS supplement effective date: October 15, 2026

Paridym, operated by Paridym Agency Inc., offers optional text-message communications. These SMS terms apply to Paridym website consultation and service communications and supplement, rather than replace, the DON Terms of Use.

Separate optional consent

If you separately opt into marketing messages, you agree to receive recurring automated texts about special offers, discounts, and Paridym services at the number you provide. If you separately opt into non-marketing messages, you agree to receive consultation confirmations, appointment reminders, and updates related to services you request. Select either, both, or neither category; both checkboxes are unchecked by default.

Providing a phone number, choosing phone as your preferred contact method, or agreeing to general consultation contact does not constitute SMS consent. Text-message consent is not a condition of purchase or of requesting a consultation. Only provide a number that you are authorized to use.

Frequency and charges

Message frequency may vary. Message and data rates may apply to messages sent to or received from Paridym. Contact your wireless provider about your messaging or data plan. Carriers are not liable for delayed or undelivered messages.

Opt out and get help

You can cancel SMS communications at any time by replying STOP to a message from Paridym. A final opt-out confirmation may be sent; no further program messages should be sent unless you opt in again. To rejoin, submit a new, separate opt-in for the category of messages you want.

For assistance, reply HELP or email support@paridym.ai. You can also contact support to withdraw your consent or report a changed or reassigned phone number.
